FREIGHT is generally NOT included unless specifically stated! This is clearly indicated on all the product pages as well as several other pages in this website. If you fail to read/see these terms of freight you are liable for the terms & conditions listed on the Shipping & Delivery page.
We can NOT control the shipping terms and delivery times of our product suppliers. Especially in the current Covid-19 situation. Some products may be ‘out of stock’ and there may be a short waiting period for restocking. The Covid-19 issue also means that delivery times may be significantly longer than usual, which is something you accept when purchasing from this website, and something we have NO control over. Delivery times may be significantly longer than expected in the current ‘pandemic’ circumstances.
We are NOT liable for extra long delivery or wait times and any project build that has commenced and parts have been ordered for CAN NOT be refunded if time frames are far longer than expected and out of our control. No deposit is refundable for any reason once a project has commenced and parts are ordered! Payment of a deposit (or payment in full) is a complete acceptance of these terms.
ANY possible Cancellations & Refunds from purchases made within the Online Shops contained in this website, are WHOLLY the decision of Custom Cruisers Australia. If a purchased shop item does not arrive (ever), or it is not as advertised, the buyer may be eligible for a refund under current Australian consumer laws. If, however, you simply change your mind, or you haven’t read the Shipping & delivery conditions, refunds/cancellations/returns will be at the sole discretion of Custom Cruisers. Payment transactions cost us processing fees and will be deducted from your refund IF applied. Custom Cruisers also have the right to retain a higher % of the transaction as stated on the Shipping & Delivery page. It costs money to transact payments and unless a product is defective or incorrectly advertised, these fees WILL be deducted from any refund agreed upon
CUSTOM BUILDS
Unless an actual Sales Contract is signed & agreed upon for the build of a custom bike project, the following terms and conditions apply.
Once a Build Project has commenced the build CAN NOT be cancelled by the new owner without being liable for the full cost of the build project, for any reason. In general the initial deposit financial outlay for a build will be required to purchase materials and equipment relevant to that particular build. This purchase is NOT refundable. The remaining balance of the project build owing WILL be payable before the build project is to be finished and/or handed over to the new owner. Usually the cost of the required materials is NOT covered with the initial deposit or outlay and the balance of payment is generally required to conclude the build project. All build projects remain the property of Custom Cruisers Australia until all final monies owing are paid.
Build projects DO NOT generally include delivery, unless specifically agreed by Custom Cruisers. Delivery is to be arranged by the new owner, or with the assistance of Custom Cruisers. International Freight is reasonably expensive (and fluid due to the current worth of the Australian Dollar) for product purchases originating from overseas suppliers, and Domestic Freight within Australia can be slow and also expensive.
Custom Cruisers Australia will NOT be liable for any delays caused by the Suppliers, Freight or Shipping Companies, or Contractors engaged by Custom Cruisers Australia to assist in the completion of any customer bike build project. Sometimes this is an unfortunate part of any custom build, usually caused by unforeseen circumstances, and as such WILL NOT be included as part of any time frames mentioned, implied or stated by Custom Cruisers Australia. Time frames for custom builds are NOT static, and are affected by many factors such as supplies, suppliers, weather, materials, and contractor issues, so any time frames given are to be used as a guide only!
Under NO circumstances will a Refund or Return be given unless specifically agreed to, stated, implied and signed IN WRITING by Custom Cruisers Australia. We always do our utmost best to deliver the best product and service possible BUT sometimes issues may delay a project which we are NOT liable for, and are not under our control.
Acceptance of Terms
The act of purchasing a product from this website, or paying a deposit (or full amount) for the commencement of a custom build, means the customer/buyer (or new owner) is bound by ALL the Terms & Conditions included in this website (Shipping & Freight, Refunds & Returns).
DISCLAIMER OF LIABILITY
The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law, CUSTOM CRUISERS AUSTRALIA and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect CUSTOM CRUISERS AUSTRALIA ` liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.
ENTIRE AGREEMENT
The above Refunds & Returns Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and CUSTOM CRUISERS AUSTRALIA (unless a Sales Contract or Custom Build Contract has been entered in to AND signed by both parties). Any waiver of any provision of the Refunds & Returns Terms of Service will be effective only if in writing and signed by an owner of CUSTOM CRUISERS AUSTRALIA.
